1. What Does This Privacy Policy Cover?

This Privacy Policy applies to information we collect: (1) on or through the Services; and (2) in email, text, and other electronic messages between you and our Services.

It does not apply to information collected by: (1) us offline or through any other means, including on any other website operated by the Company or any third party (including our affiliates and subsidiaries); or (2) any third party, including through any application or content that may link to or be accessible from or on our Services. This Privacy Policy does not apply to Open Source Software (as defined in the EUAL).

We gather various types of Personal Information from our users, as explained more fully below. We may use this Personal Information to personalize and improve our services, to contact users, to fulfill your requests for certain products and services, to analyze how users utilize the Services, and as otherwise set forth in this Privacy Policy. We may share certain types of Personal Information with third parties, as described below.

THE SERVICES ARE NOT INTENDED FOR CHILDREN UNDER 18 YEARS OF AGE.

We do not knowingly collect or solicit Personal Information from anyone under the age of 13 or knowingly allow such persons to register for our Services. If you are under 13, please do not attempt to register for the Services or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any Personal Information to us or on the Services. In the event that we learn that we have collected Personal Information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. 2. What Information Does the Company Collect and How?

We collect this information (i) directly from you when you provide it to us; and (ii) automatically as you navigate through the Service.   • Account information:Any information about you when you register for an account or otherwise engage with the Services such as your name and email address you provide during account creation, and your payment info, company name, phone number, title and physical address when you convert to a paid account.
  • Information you provide us: Any information you provide by contracting us through the Service, or any additional information you provide that we may ask for if you report a problem with the Service, your search queries on the Service, and details of transactions you carry out through the Service. You agree and acknowledge that by submitting such information that you have the authority and necessary consents to provide such information.
  • Application data:Any data that you add to any interactive features of the Services(such as cards, comments, etc.) is stored in our systems. Additionally, when you use any of our applications, we store some usage analytics, the directory, folder and file names on your device where you store your code, and any crash reports sent from your client.
  • Service telemetry and usage data:  As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including, without limitation: (a) telemetry data and details of your use of the Services, logs, location data and other communication data and the resources that you access and use on the Services; (b) information about your computer and internet connection, including your IP address (including geolocation), operating system, product version, and browser type; and (c) your preferences, such as language selection. If you access the Service through a mobile device, we may also be able to identify the location of your mobile device. You may choose not to share your location details with us by adjusting your mobile device’s location services settings.  For instructions on changing the relevant settings, please contact your service provider or device manufacturer. 
  • Cookies:We use “cookies” when you use or access our browser-based Services. A cookie is a piece of data stored on your hard drive or smartphone, to help us improve your access to our site and identify repeat visitors to our site. For instance, when we use a cookie to identify you, you would not have to login a password more than once, thereby saving you time. Cookies can also enable us to track and target the interests of our users to enhance the experience. Usage of a cookie is in no way linked to any of your personally identifiable information e.   • Log Files: As is true of most websites and services, we may collect certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, clickstream data. For our cloud based Services, the information we collect may include the URLs you accessed (in our log files), usernames as well as elements of your content (such as Jira project names, project keys, status names, and JQL filters, and confluence page titles and space names) as necessary for the cloud Services to perform the requested operations. Occasionally, we connect Personal Information to information gathered in our log files as necessary to improve the Services for individual customers. We do not link this automatically collected data to other information we collect about you.
  • Web Beacons: Pages of the Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
  • Third Party Analytics: Third party analytics service providers will receive data regarding your usage of our Services in order to provide analytics services to us. If you elect to opt-out of such data collection (to the extent available) and subsequently use our Services through a different device or otherwise change your cookie or privacy settings on your device, you will need to opt-out again.
  • Third Parties: We may also obtain information from third-parties and combine that with information we collect through the Services. For example, we may have access to certain information from a third-party service provider’s service or authentication service if you log into our Services through such a service or otherwise provide us with access to information from the service. Any access that we may have to such information from a third-party service or authentication service is in accordance with the authorization procedures determined by that service. By authorizing us to connect with a third-party service, you authorize us to access and store your information that the third-party service makes available to us, and to use and share it in accordance with this Privacy Policy. You should check your privacy settings on these third-party services to understand and change the information sent to us through these services.

  • The BigBrassBand Team:Information may be shared internally, including our affiliates and subsidiaries, to help provide, improve, protect, and promote our service.
  • Service Providers: We may disclose information to our contractors, service providers, and other third parties we use to support our business. For example, third party payment processors.
  • 3rd Party Applications:If you choose to integrate our Services with 3rd party applications, such as HubSpot, Tableau, Chargebee, Stripe, Netsuite and ChartMogul. Such third parties have their own privacy policies and terms that govern their use of your information..
  • Legal:We may disclose your information to third parties if necessary to comply with any court order, law, or legal process, including to respond to any government or regulatory request, or to otherwise enforce our End User License Agreement, Terms of Use, or any other agreement between you and the Company, including without limitation, for billing and collection purposes.
  • Acquisition: We may disclose your information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets and any preliminary negotiations and diligence thereto, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by the Company about our Service users is among the assets transferred.
  • To Fulfill Your Request: We may disclose your information to fulfill the purpose for which you provided it, or for any purpose disclosed by us when you provide the information.
  • Protection: We may disclose your information if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.


Finally, we never use, share, sell or rent the Personal Information provided to us online in ways unrelated to the ones described in this Privacy Policy without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.


4. Is Personal Information About Me Secure?

The security of your Personal Information is important to us. While we endeavor to protect the privacy of your Personal Information we hold in our records, unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Services. Any transmission of information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on or through the Services.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) certain access credentials for use of the Service, you are responsible for keeping this information confidential. You can always opt not to disclose information to use, but keep in mind some information may be needed to register with us or to take advantage of some of our special features.

We may not accommodate a deletion of information if we believe the change would violate any law or legal requirement. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We use this procedure to better safeguard your information. 

Do-Not-Track Policy: Some web browsers may transmit “do-not-track” (“DNT”) signals with which you may communicate. We currently do not change our tracking practices in response to DNT Settings in your web browsers. To determine whether any of the third-party services the Company uses honor the “Do Not Track” requests, please read their privacy policies.

We retain Personal Data about you for as long as you are a customer. In some cases, we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation.

Afterwards, we retain some information for marketing and promotional activities, unless you have opted out of such promotions.

9. Special Notice for California Residents.

The California Consumer Protection Act (“CCPA”) requires specific disclosures to California residents. These required disclosures are organized separately for convenience and to reflect terminology used in the CCPA but the Company’s privacy notice will provide additional detail on its privacy practices. 10. Special Notice for Nevada Residents.

The Privacy and Security of Personal Information Chapter of Nevada law provides that where certain types of Personal Information (“Covered Information”) are collected via a website or online service maintained by the operator of such site that the operator notify the consumer of the categories of information collected; how it is collected, shared, used and, where applicable, access by third parties.
